MINNEAPOLIS (Legal Newsline) — Three West Coast customers are suing My Pillow, alleging fraud.
Donald Puckett of Oregon, Patrick Kavanagh of Washington state and Theresa Cordero of California filed a class action complaint, individually and on behalf of all similarly situated individuals, Jan. 4 in U.S. District Court for the District of Minnesota against My Pillow Inc. alleging false representations regarding the prices of its pillow.
According to the complaint, the plaintiffs sustained monetary damages from purchasing a pillow that was advertised as buy-one-take-one but, in actuality, is being priced as near the combined regular price for two pillows.
The plaintiffs allege My Pillow misleads consumers into purchasing its pillows making buyers believe they are saving money from participating in their buy-one-take-one promotion when, in fact, they're paying for two pillows.
The plaintiffs seek trial by jury, injunctive relief, actual damages, three times actual damages, participation in a corrective advertising campaign, restitution court costs and all further relief the court grants.
