NEWARK, N.J. (Legal Newsline) — A New Jersey school district is suing the manufacturers of a field turf, alleging design defect and product liability.
The state-operated School District of the city of Newark filed a class action complaint, individually and on behalf of all those similarly situated New Jersey school districts, Dec. 17 in Superior Court of New Jersey against FieldTurf USA Inc., formerly known as FieldTurf International, Inc., FieldTurf Tarkett, Inc., FieldTurf Inc., and ABC Corp. I-X., alleging they manufactured and sold defective turf fields to the plaintiffs.
According to the complaint, the Newark School District suffered monetary damages from purchasing a defective field turf. The plaintiff alleges the defendants had knowledge that their product was prone to premature deterioration and failed to inform the plaintiff regarding this defect.
The defendant removed the case to U.S. District Court for the District of New Jersey on Dec. 29.
The Newark School District seeks trial by jury, monetary relief, injunctive relief, actual damages, treble damages, statutory civil penalties, all legal fees plus interest and all other relief the court deems just.
