WASHINGTON (Legal Newsline) – A former and a current employee of Whole Foods allege they were not paid bonuses.
Michael Molock and Randal Kuczor filed a complaint on behalf of others similarly situated on Dec. 20 in the U.S. District Court for the District of Columbia against Whole Foods Market Inc. and Whole Foods Market Group Inc. alleging breach of contract, unjust enrichment and other counts.
According to the complaint, the defendants use a Gainsharing program for employee bonuses. The plaintiffs hold Whole Foods Market Inc. and Whole Foods Market Group Inc. responsible because the defendants allegedly failed to pay the bonuses earned in the Gainsharing program but instead shifted labor costs to strip bonuses from employees.
The plaintiffs request a trial by jury and seek compensatory damages of more than $75,000 plus interest, treble unpaid wages, punitive damages in the amount of $200 million or 10 percent of the net value of defendants, court costs and any further relief the court grants.
