Wegmans Food Markets Inc. alleged to have not provided consumer report disclosure

ROCHESTER, N.Y. (Legal Newsline) – Two New York residents allege a supermarket chain obtained a consumer report when they applied for employment without including a disclosure.

Ashleigh Wheeler and Jerah Brewster filed a complaint on behalf of the class on Dec. 17 in the U.S. District Court for the Western District of New York against Wegmans Food Markets Inc. alleging violation of the Fair Credit Reporting Act.

According to the complaint, the plaintiffs allege that they suffered damages from not being informed that a consumer report will be conducted as a result of their application of employment with the defendant. The plaintiffs hold Wegmans Food Markets Inc. responsible because the defendant allegedly failed to provide their applicants a stand-alone disclosure, which they allege violates the FCRA.

The plaintiffs request a trial by jury and seek award service payments, issue a proper notice of the class, statutory damages, punitive damages, all legal fees and any other relief as the court deems just.
