Nestle accused of falsely advertising Lean Cuisine meals as preservative-free

NEW YORK (Legal Newsline) – A consumer has filed a class action lawsuit over allegations that a brand of frozen meals is falsely listed as being made with no preservatives

Courtney Ross filed a complaint on behalf of others similarly situated on Dec. 12 in the U.S. District Court for the Southern District of New York against Nestle USA Inc. alleging unjust enrichment, fraud and other counts.

According to the complaint, the plaintiff alleges that she suffered damages from purchasing a falsely advertised product. The plaintiff holds Nestle USA Inc. responsible because the defendant allegedly falsely advertises that its Lean Cuisine frozen meals do not have preservatives despite the meals listing citric acid as an ingredient.

The plaintiff requests a trial by jury and seeks restitution and disgorgement plus interest, compensatory damages, actual and statutory damages, for the defendant to engage in a corrective advertising, all legal fees plus interest and any other relief as the court deems just. She is represented by C.K. Lee and Anne Seelig of Lee Litigation Group PLLC in New York.
