RALEIGH, N.C. (Legal Newsline) – A North Carolina consumer has filed a class action lawsuit against a furniture company over allegations it did not add a treatment to protect furniture from spills as promised.
Kenny Triplett filed a complaint on behalf of others similarly situated on Dec. 1 in the U.S. District Court for the Eastern District of North Carolina-Western Division against Rooms To Go North Carolina Corp., doing business as Rooms To Go, and others, alleging breach of contract, unjust enrichment and other counts.
According to the complaint, the plaintiff alleges that he suffered damages from having paid for a furniture without any fabric protectant in 2015. The plaintiff holds the defendants responsible because they allegedly delivered plaintiff's furniture without any fabric protectant to protect it from spills during transport despite the plaintiff paying for the protectant.
The plaintiff requests a trial by jury and seeks restitution, disgorgement, compensatory and actual damages, statutory damages, treble damages, interest, punitive damages, all legal fees and any other relief as the court deems just.
