LOS ANGELES (Legal Newsline) – A consumer has filed a class action lawsuit against the manufacturers of a child's car seat alleging the product contains a chemical that might harm the children using them.

Spencer Price filed a complaint on behalf of all others similarly situated on Nov. 30 in the U.S. District Court for the Central District of California against Orbit Baby Inc. and The Ergo Baby Carrier Inc. alleging violation of the California Consumer Legal Remedies Act, common law fraud and other counts.

According to the complaint, the plaintiff alleges that he suffered damages from being misled into purchasing the Orbit Baby Essentials G2 Car Seat that might cause harm to his child.

The plaintiff holds Orbit Baby Inc. and The Ergo Baby Carrier Inc. responsible because the defendants allegedly made false claims regarding the amount of the flame-retardant chemical known as chlorinated tris in the product, which allegedly is known to cause cancer or reproductive harms.

The plaintiff requests a trial by jury and seeks actual, general, special, incidental, statutory, punitive and consequential damages; restitution; interest; all legal fees and any other relief as the court deems just. He is represented by Richard D. McCune and David C. Wright of McCune Wright Arevalo, LLP in Ontario, California; and Joseph G. Sauder, Matthew D. Schelkopf and Joseph B. Kenney of McCuneWright LLP in Berwyn, Pennsylvania.
