Two consumers accuse Herr Foods of false advertising

BROOKLYN, N.Y. (Legal Newsline) — Two consumers are suing Herr Foods, alleging negligent misrepresentation.

Kedney Merisier of Queens, New York, and Dreu Vanhoose of Washington, D.C.,  filed a class action complaint, individually and on behalf of others similarly situated, Nov. 15 in U.S. District Court for the Eastern District of New York against Herr Foods Incorporated, alleging Herr misleads consumers regarding the quantity of potato chips contained per package.

According to the complaint, Merisier and Vanhoose suffered monetary damages from purchasing falsely advertised potato chips. The plaintiffs allege Herr Foods deceives consumers regarding to total volume of chips inside the bag.

The plaintiffs seek trial by jury, compensatory and punitive damages, interest, restitution, injunctive relief, court costs and all further relief the court grants. They are represented by attorneys C.K. Lee and Anne Seelig of Lee Litigation Group PLLC in New York.
