Krispy Kreme donuts don't have actual fruit, class action says

LOS ANGELES (Legal Newsline) — A California man is suing Krispy Kreme Doughnuts Inc., alleging breach of contract, breach of implied warranty, fraud and negligent misrepresentation.

Jason Saidian of Los Angeles County filed a class action complaint, individually and on behalf of all others similarly situated Nov. 9, in U.S. District Court for the Central District of California against Krispy Kreme Doughnuts Inc., alleging the defendant made false claims regarding the ingredients of its products.

According to the complaint, Saidian sustained monetary damages from purchasing a falsely advertised product. The plaintiff alleges Krispy Kreme says their doughnuts contains blueberry despite not containing actual blueberries.

Saidan seeks trial by jury, compensatory and punitive damages, interest, restitution, injunctive relief, court costs and all relief the court grants. He is represented by attorneys Barbara A. Rohr and Benjamin Heikali of Faruqi & Faruqi LLP in Los Angeles.
