Alabama couple allege Pella windows are defective and cause wood rot

BIRMINGHAM, Ala. (Legal Newsline) – An Alabama couple have filed a class action suit against an Iowa window manufacturer over allegations the windows are defective.

Tony and Belinda Gowins filed a complaint on behalf of all others similarly situated on Oct. 5 in the U.S. District Court for the Northern District of Alabama, Eastern Division against Pella Corp. alleging negligence, breach of implied warranty and other counts.

According to the complaint, the plaintiffs allege that they suffered damages from purchasing a defective product. The plaintiffs hold Pella Corp. responsible because the defendant allegedly failed to inform the plaintiffs regarding the defect of its windows, which allows water to enter behind the aluminum cladding and causes premature wood rot and deterioration to the windows and structure

The plaintiffs request a trial by jury and seek compensatory damages, court costs and interest plus any further relief the court grants. They are represented by Eric D. Hoaglund of McCallum, Hoaglund, Cook & Irby LLP in Vestavia Hills, Alabama, and K. Edward Sexton II of Gentle, Turner, Sexton & Harbison LLC in Hoover, Alabama.
