Wal-Mart accused of not honoring the warranty of its car batteries

SACRAMENTO, Calif. (Legal Newsline) — A consumer has filed a class-action lawsuit against Wal-Mart Stores, Inc., and Does 1-10, retail store, citing alleged negligent misrepresentation.

Larry Maestas filed a complaint on behalf of other members of the general public similarly situated on Oct. 31, in the U.S. District Court for the Eastern District of California against the defendants alleging that they made false claims regarding the warranty of their car batteries.

According to the complaint, the plaintiff alleges that he suffered damages from being misled into purchasing a product with a falsely advertised warranty. The plaintiff holds Wal-Mart Stores, Inc., and Does 1-10 responsible because the defendants allegedly failed to disclose to the consumers that they would not honor the warranty of their car batteries.

The plaintiff requests a trial by jury and seeks to order the defendant to engage in a corrective advertising, actual damages, punitive damages, statutory enhanced damages, court costs and interest plus any further relief this court grants.
