LOS ANGELES (Legal Newsline) – A California individual has filed a class action lawsuit against a HVAC products and services marketer and distributor over allegedly unsolicited phone calls.
Tyler Bayer filed a complaint on behalf of all others similarly situated on Oct. 29 in the U.S. District Court for the Central District of California against Serviz Inc. and Does 1 through 10 citing the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that beginning in December 2015, the defendant called him in an attempt to solicit its company. The plaintiff alleges his number is on the National Do-Not-Call Registry. The plaintiff holds Serviz Inc. and Does 1 through 10 responsible because the defendants allegedly used an automatic telephone dialing system to call plaintiff's cellular phone without his consent.
The plaintiff requests a trial by jury and seeks $500 in statutory damages, $1,500 in treble damages, all legal fees and any other relief as the court deems just. He is represented by Todd M.
