PHOENIX (Legal Newsline) — Three Arizona women are suing Bank of America, alleging fraud and unjust enrichment.
Daria Brill, Andrea Morales, and Gale Zylstra filed a class action complaint, individually and on behalf of all others similarly situated, Nov. 3 in U.S. District Court for the District of Arizona against Bank of America NA, and Does 1-10, alleging failure to fully disclose fees to releasees.
According to the complaint, Brill, Morales and Zylstra suffered monetary damages due to undisclosed fees associated with the release of their money. The plaintiffs allege the defendants failed to properly disclose the necessary steps including the activation instruction of the Bank of America debit card.
The plaintiffs seek trial by jury, restitution, disgorgement, actual damages, injunction, punitive and exemplary damages, all legal fees and interest and any other relief the court deems just. They are represented by attorneys Jo Ann Niemi of Anapol Weiss in Scottsdale, Arizona, and by Ruben Honik and David J. Stanoch of Golomb & Honik PC in Philadelphia.
