LOS ANGELES (Legal Newsline) — A California consumer is suing Dole, alleging negligent misrepresentation.
Salvador Amaya of Whittier filed a class action complaint, individually and on behalf of all others similarly situated, Oct. 18 in U.S. District Court for the Central District of California against Dole Packaged Foods LLC, alleging false claims regarding a Dole product in order to mislead consumers.
According to the complaint, Amaya suffered monetary damages from being misled into purchasing a falsely advertised Dole product. The plaintiff alleges Dole markets its high sugar products as healthy despite the significant health risk involved of taking in foods with too much sugar.
Amaya seeks trial by jury, ordering Dole to engage in a corrective advertising campaign, pay actual, compensatory, punitive and statutory damages, disgorgement, restitution, all legal fees and all other relief the court deems just.
