BROOKLYN, N.Y. (Legal Newsline) — A Bronx man is suing a maker of insole products, alleging breach of warranty, negligent misrepresentation and unjust enrichment.
Jose Izquierdo and John Does 1-100 filed a class action complaint, individually and on behalf of all others similarly situated, Oct. 5 in U.S. District Court for the Eastern District of New York against Blistex Inc. alleging the defendant made false claims regarding the efficiency of its insole product.
According to the complaint, the plaintiffs suffered monetary damages from being misled into purchasing a falsely advertised product manufactured by Blistex. The plaintiff alleges Blistex deceived consumers into paying more for insoles advertised as Odor Eaters and capable of destroying foot odor.
Izquierdo seeks trial by jury, restitution and disgorgement, compensatory damages, actual and statutory damages, order the defendant to cease wrongful acts, order the defendant to engage in a corrective advertising, injunctive relief, interest, court costs and all further relief this court grants.
