LOS ANGELES (Legal Newsline) — A San Diego County man is suing jewelry distributors, alleging breach of warranty, fraud, negligent misrepresentation and unjust enrichment.
Sydney Greenbaum filed a class action lawsuit, individually and on behalf of all others similarly situated, Sept. 13 in U.S. District Court for the Central District of California against KC Jewelry Inc., Rouben Youssian, Ramin Yosian, Modern Jewelry Inc., Does 1-50 and Roes 1-500, alleging failure to conduct business in good faith.
According to the complaint, on Feb. 29, Greenbaum purchased from Modern Jewelry a ring manufactured by KC Jewelry. The suit says the ring was represented to contain 4.25 carats of diamonds, but when Greenbaum had the ring disassembled it was found to only weigh 3.87 carats.
The lawsuit states Greenbaum and other the class members paid more than they would have otherwise, leading to a monetary loss. The plaintiff alleges the defendants obtained profits at the expense of the plaintiffs, failed to reflect the true value of their products and failed to provide an honest and accurate information of the products being sold.
Greenbaum seeks trial by jury, an order certifying this case a class action suit, restitution, disgorgement, an order enjoining defendants from further violation, costs of suit, attorney fees, interest and all relief the court deems appropriate.
