NEW YORK (Legal Newsline) — A New York consumer is suing a food company, alleging negligent misrepresentation and unfair competition.
Brittany Pepper of Stormville, New York, filed a class action lawsuit, individually and on behalf of all others similarly situated, Aug. 17 in U.S. District Court for the Southern District of New York against Boulder Brands Inc., alleging deceptive advertising.
According to the complaint, Pepper suffered financial damages from purchasing a low sodium spread which contains less product than the original spread. The plaintiff alleges Boulder Brands misled consumers into purchasing the low sodium and EVOO buttery spreads which contains less product.
Pepper seeks trial by jury, plus treble damages, interest, court costs and any further relief the court grants. She is represented by attorneys Jeffrey I. Carton, Robert J. Berg and Myles K. Bartley of Denlea & Carton LLP in White Plains, New York.
