The McMillan Law Firm allegedly sent inflated bill to client

SAN DIEGO (Legal Newsline) - An individual has filed suit against a law firm for alleged breach of contract, fraud and negligence, citing duplicate entries and other errors on the billing statement.

L. Lee Brightwell filed a complaint June 30 in the U.S. District Court for the Southern District of California against The McMillan Law Firm APC, Scott A. McMillan, Michelle D. Volk and Does 1 through 25, alleging they billed the plaintiff for an additional $60,000.

According to the complaint, the plaintiff alleges she suffered damages from being over billed and being threatened should she fail to pay it.

Brightwell holds the law firm, McMillan, Volk and and the "Does" responsible because the defendants allegedly withdrew as the plaintiff's counsel when she asked for time to review the bill.

The plaintiff requests a trial by jury and seeks general and special damages, declare that the plaintiff is entitled to receive the entirety of the settlement funds totaling $151,922.59, interest, punitive damages, all legal fees and any other relief as this court deems just.
