King County homeowners accuse shingles manufacturer of breaching warranty

SEATTLE — Two King County homeowners are suing a building materials manufacturer, alleging fraud and misrepresentation.

Paula Wetzel and Joel Wetzel filed a class action complaint, individually and on behalf of other similarly situated persons, July 27 in Superior Court of the State of Washington for King County against CertainTeed Corporation, alleging violation of the Washington State Consumer Protection Act.

According to the complaint, Paula Wetzel and Joel Wetzel have suffered financial damages on their King County property and were caused to pay an artificially inflated price for their home and expended money to replace or repair the defective shingles and remedy any structural damage caused by CertainTeed. 

The plaintiffs allege CertainTeed designed, manufactured, marketed and sold defective shingles, misrepresented that its shingles are free from manufacturing defects and refused to repair or replace defective shingles.

The Wetzels seek trial by jury, an order appointing the plaintiffs as representatives of the class and its subclass, compensation for all damages, pre- and post-judgment interest, attorney fees, legal costs and expenses and such other relief the court dems proper. They are represented by attorneys Albert H. Kirby of Sound Justice Law Group PLLC in Seattle and Catherine J. Fleming and Brad J. Moore of Stritmatter Kessler Whelan Koehler Moore Kahler, also in Seattle.

The defendant removed the case to U.S. District Court for the Western District of Washington July 27.
