CHICAGO (Legal Newsline) – An animal feed manufacturer is accused of manufacturing a horse feed containing an ingredient that is poisonous to the animals.
Beth Berarov and Annelisa Bindra filed a complaint on behalf of all others similarly situated in the U.S. District Court for the Northern District of Illinois against Archer-Daniels-Midland Co. and ADM Alliance Nutrition Inc. citing the Illinois Food, Drug and Cosmetic Act and other counts.
According to the complaint, the plaintiffs allege that their horses died from ingesting feed that was contaminated with monensin, a chemical addictive used in cattle feed that is poisonous to horses, found in the defendants' feed.
The plaintiffs hold Archer-Daniels-Midland Company and ADM Alliance Nutrition Inc. responsible because the defendants allegedly failed to properly manufacture their products in order to avoid contaminating them with monensin. They allege the defendants manufacture horse feeds and supplements in a mill that also produces animal feeds with monensin.
The plaintiffs request a trial by jury and seek enjoining defendants from pursuing the unlawful acts, order the defendant to remove its deceptive and misleading statements from its websites and engage in a corrective advertising, full restitution and actual, statutory, and punitive damages, disgorgement, court costs and any further relief this court grants.
