CHICAGO (Legal Newsline) – An Illinois homeowner has filed a class action lawsuit against a mortgage service provider and its vendor over allegations he was subjected to unreasonable and unnecessary property inspections.
George Michael filed a complaint on behalf of all others similarly situated in the U.S. District Court for the Northern District of Illinois, Northern District against CitiMortgage Inc. and Safeguard Properties LLC alleging violation of the Racketeer Influence and Corrupt Organizations Act and other counts.
According to the complaint, the plaintiff alleges that he fell behind on his mortgage payments with CitiMortgage in 2010 and that CitiMortgage had Safeguard Properties conduct unwarranted property inspections.
The plaintiff holds CitiMortgage Inc. and Safeguard Properties LLC responsible because the defendants allegedly conspired together to utilize a system of imposing fees for property inspections, automatically charged fees to the account of the borrower and unlawfully generated substantial income from default-related service fees.
The plaintiff requests a trial by jury and seeks an award of monetary and/or equitable relief, statutory damages, punitive damages, attorney's fees, costs and such other relief as the court may deem appropriate. He is represented by Anthony M. Klytta of Klytta & Klytta in Des Plaines, Illinois.
