New York customer alleges Kimlan Foods misrepresented products

Preservatives

BROOKLYN, N.Y. (Legal Newsline) - A Brooklyn customer is suing a food company, alleging it misrepresents certain of its products.

Miao Xin Hu and John Does 1-100, individually and for all others similarly situated, filed a class action lawsuit May 4 in U.S. District Court for the Eastern District of New York against Golden Orchid Ltd., doing business as Kimlan Foods U.S.A., and Kimlan Foods Co. Ltd., alleging violations of consumer protection statutes in every state, violations of the New York General Business Law, negligent misrepresentation, breach of express warranties, and unjust enrichment.

The suit alleges the defendants market and label several of their jarred food products as free of preservatives, when the products contain citric acid, a non-natural, chemically processed ingredient used as a preservative.

Miao and others in the class seek a jury trial, declaratory and injunctive relief, compensatory and punitive damages, interest, restitution, attorney fees and costs of the suit. They are represented by attorneys C.K. Lee and Anne Seelig of Lee Litigation Group in New York.
