FRANKFURT, Ky. (Legal Newsline) – Kentucky joined in a $39 million multi-state settlement with Endo Health Solutions and its wholly owned subsidiary Qualitest, Attorney General Andy Beshear announced.
Qualitest, a manufacturer of pharmaceutical products, allegedly conducted unlawful labeling practices involving children’s multivitamin tablets with fluoride. The company, according to claims, marketed the tablets as containing the FDA-recommended amount of fluoride but actually developed the tablets with less than half that amount.
Kentucky joined 47 other states and the federal government in the settlement agreement. The state’s Medicaid Program will receive more than $2,000.
“Qualitest placed our children at risk for greater rates of decay and other dental problems because it simply didn’t provide the product it said it was providing and for which the company was paid,” Beshear said. “This settlement is a win in our fight to better protect Kentucky’s children and Kentucky families.”
Spearheading Kentucky’s efforts in the settlement was Beshear’s Medicaid Fraud and Abuse Unit.
