Consumer accuses Facebook of texting members without consent

SAN FRANCISCO (Legal Newsline) - A Washington, D.C., woman is suing Facebook, alleging it texts its members without their consent.

Christine Holt, individually and for all others similarly situated, filed a class action lawsuit April 26 in U.S. District Court for the Northern District of California San Francisco Division against Facebook Inc., alleging violations of the Telephone Consumer Protection Act and the California Business & Professions Code.

The suit alleges Facebook uses its members' collected cellphone information to send unsolicited text messages to thousands of cellphone numbers without the recipients' consent. Facebook, the lawsuit states, uses an automatic telephone dialing system to send these messages.

Holt and others in the class seek a jury trial, declaratory and injunctive relief, actual and statutory damages, restitution and disgorgement, and attorney fees and costs. They are represented by attorney Todd Logan of Edelson PC in San Francisco.
