TRENTON, N.J. (Legal Newsline) - A New Jersey woman is suing Saks, alleging its website's terms and conditions contain illegal provisions.
Fay Rubin of Lakewood, New Jersey,, individually and for all others similarly situated, filed a class action lawsuit April 19 in U.S. District Court for the District of New Jersey against Saks Direct Inc., alleging violations of the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act.
The suit alleges the terms and conditions on the defendant's website, www.saksfifthavenue.com, contain provisions that blatantly obscure the effects of their disclaimers on New Jersey residents, as they do not state when certain liability provisions may be void, unenforceable or inapplicable in New Jersey.
Rubin and others in the class seek a jury trial, injunctive relief, a judgment of at least $100 per violation for each class member, attorney fees and costs. They are represented by attorney Fred M. Zemel of The Zemel Law Firm in Newark, New Jersey.
