LOS ANGELES (Legal Newsline) - A California man is suing Samsung, alleging it misrepresents certain of its televisions.
Frank Nance of Yorba Linda, California, individually and for all others similarly situated, filed a class action lawsuit April 14 in U.S. District Court for the Central District of California against Samsung Electronics America Inc., alleging violations of New Jersey's Consumer Fraud Act, California's Business & Professions Code and California's Consumer Legal Remedies Act.
The suit alleges Samsung advertised certain televisions as LED TVs but failed to disclose that its references to LED relate not to the display technology itself but to the light source that illuminates an LCD panel. The televisions in question, the lawsuit states, are visually indistinguishable from televisions advertised and sold as LCD TVs.
Nance and others in the class seek a jury trial, injunctive relief, restitution, compensatory and statutory damages, treble and punitive damages, interest, attorney fees and costs.
