New York woman alleges Newark Prudential operators imposed unlawful terms, conditions

NEWARK, N.J. (Legal Newsline) - A New York woman is suing the operators of Newark's Prudential Center, alleging its terms and conditions unlawfully attempt to absolve itself from any liability.

Josephine Guzman, individually and for all others similarly situated, filed a class action lawsuit April 11 in U.S. District Court for the District of New Jersey against Devils Arena Entertainment LLC, alleging violations of New Jersey's Truth-in-Consumer Contract, Warranty and Notice Act (TCCWNN).

The suit alleges Devils Arena Entertainment's website, www.prucenter.com, contains terms and conditions that purport to impose legal, exculpatory or other provisions upon all users of the website, and purport to nullify certain legal duties and responsibilities Devils Arena Entertainment owes its customers.

  

The unfair, one-sided provisions in the defendant's terms and conditions violate the TCCWNN, the suit says.

  

Guzman and others in the class seek a jury trial, at least $100 per class member for each violation of the TCCWNN, injunctive relief, attorney fees and court costs. They are represented by attorneys Avi Naveh in Fair Lawn, New Jersey, and Jeffrey M. Gottlieb and Dana L. Gottlieb of Gottlieb & Associates in New York.
