BROOKLYN, N.Y. (Legal Newsline) – A New York woman is suing a candy manufacturer over claims it underfills certain of its products.
Nikita Godsonov and John Does 1-100, individually and for all others similarly situated, filed a class-action lawsuit April 11 in U.S. District Court for the Eastern District of New York against Mars Inc., alleging violations of the New York General Business Law, negligent misrepresentation, common law fraud and unjust enrichment.
The suit states that the defendant packages its M&M's Mini products in tubular containers made and filled as to be misleading, containing excessive empty space.
Godsonov and others in the class seek a jury trial, injunctive and declaratory relief, compensatory and punitive damages, restitution, interest, attorney fees and costs of the suit. They are represented by attorneys C.K. Lee and Anne Seelig of Lee Litigation Group in New York.
