BATESVILLE, Ark. (Legal Newsline) – The organizers of a music festival are being sued after they canceled the festival and allegedly kept proceeds from tickets and other sales.
Sheila Alexander, Brielle Thomas, Tiffany Dailey, Tisha Gribble and David L. Winberry, individually and for all others similarly situated, filed a class-action lawsuit Dec. 11, 2015, in Circuit Court of Independence County Arkansas against Pipeline Productions, Backwood Enterprises, Brett Mosiman, The Madison Cos., and Horsepower Entertainment, alleging breach of contract.
According to the complaint, the defendants were to put on Thunder on the Mountain, a weekend music festival at Mulberry Mountain near Ozark, Arkansas, from June 26-28, 2015.
However, 11 days before the festival was to begin, the defendants abruptly canceled it, the suit states. The defendants allegedly kept the money gained from the purchase of festival tickets, camping and parking passes, and vendors that purchased booths to sell their products and services during the event.
The plaintiffs and others in the class seek declaratory relief, repayment, interests, attorney fees and other costs. They are represented by attorneys Stephen B. Brauerman, Vanessa R. Tiradentes and Sara E. Bussiere of Bayard PA in Wilmington, Delaware, and Richard B. Benenson of Brownstein Hyatt Farbar Schreck in Denver.
The case was later removed to U.S. District Court for the Eastern District of Arkansas.
