LOS ANGELES (Legal Newsline) - Two California residents are suing Kraft Heniz, alleging it misrepresents a certain cheese product.

Adam Weiss and Patty Morelos, individually and for all others similarly situated, filed a class action lawsuit April 1 in U.S. District Court for the Central District of California Southern Division against The Kraft Heinz Company, alleging breach of express warranty and violation of California's Business & Professions Code and its Consumer Legal Remedies Act.

According to the suit, Kraft Heinz labels and advertises its grated Parmesan cheese product as being 100 percent Parmesan cheese. However, the lawsuit states, the product is not 100 percent cheese but, in fact, contains at least 3.8 percent cellulose, a filler derived from wood pulp.

Weiss, Morelos, and others in the class seek a jury trial, declaratory and injunctive relief, actual damages, punitive damages, statutory damages, interest, attorney fees and litigation costs. They are represented by attorneys Timothy G. Blood, Thomas J. O'Reardon, II, and Camille S. Bass of Blood Hurst & O'Reardon in San Diego, David R. Markham and Peggy J. Reali of The Markham Law Firm in San Diego, and Walter L. Haines of United Employees Law Group in Huntington Beach, California.
