Two women accuse 21st Century Oncology of failing to protect data

FORT MYERS, Florida (Legal Newsline) - Two women are suing a cancer care centers company, alleging a data breach exposed patients' information.

Stacey Schwartz of Florida and Judith Cabrera of Massachusetts, individually and for all others similarly situated, filed a class action lawsuit March 29 in U.S. District Court for the Middle District of Florida Fort Myers Division against 21st Century Oncology Holdings, alleging negligence, negligence per se, invasion of privacy, and violations of the Florida Unfair and Deceptive Trade Practices Act.

  

The suit states on March 4, 21st Century disclosed that its electronic systems had been breached in October 2015 and, as a result, more than 2 million patients' personal and medical information was exposed and stolen.

The defendant's electronic systems had previously been breached in 2012, the lawsuit states, but, even after that breach, its security systems and practices remained substandard and inadequate, failing to comply with applicable law.

Schwartz, Cabrera and others in the class seek a jury trial, actual and statutory damages, injunctive relief, interests, and attorney fees and costs. They are represented by attorneys Robert C.
