Tennessee man alleges Love's charges excessive credit card holds

KNOXVILLE, Tennessee (Legal Newsline) - A Tennessee man is suing a highway convenience stores and gas stations company, alleging it places undisclosed and excessive credit "holds" on customers' credit card accounts.

  

Kevin Thompson of Knox County, individually and for all others similarly situated, filed a class action lawsuit March 24 in U.S. District Court for the Eastern District of Tennessee Northern Division at Knoxville against Love's Travel Stops & Country Stores Inc., alleging violations of deceptive and unfair trade practices acts in many states, breach of implied-in-fact contract, unjust enrichment and fraudulent concealment.

The suit alleges when a customer swipes a Visa or MasterCard credit card at a pay-at-the-pump machine at a Love's Travel Stop, Love's exerts a credit card hold to secure full payment for fuel purchases. However, the complaint states, Love's exerts these holds without customers' knowledge or consent, and the amount charged on the holds significantly exceeds the actual cost of the fuel purchases.

Thompson and others in the class seek a jury trial, damages, restitution, injunctive relief, interests, attorney fees and costs of the suit. They are represented by attorneys Gordon Ball of Knoxville, Thomas C. Jessee of Jessee & Jessee in Johnson City, Tennessee, and Lance K. Baker of The Baker Law Firm in Knoxville.
