LOS ANGELES (Legal Newsline) – A California woman is suing a non-medicinal skin creams producer over claims it misrepresents its products as being made in the U.S.
Natalie Rossetti, individually and for all others similarly situated, filed a class-action lawsuit Feb. 11 in Los Angeles Superior Court against Stearn's Products, doing business as derma e, alleging negligent and intentional misrepresentation, violation of California's Consumer Legal Remedies Act, and violations of California's Business and Professions Code.
The suit states Stearn's falsely labels its products as being made in the U.S., when in fact they contain ingredients that are manufactured, grown, and/or sourced outside the U.S.
Rossetti and others in the class seek a jury trial, recovery of the amounts by which the defendant has been unjustly enriched, injunctive relief, attorney fees, and other costs of the suit. The defendant transferred the case to the U.S. District Court for the Central District of California because the proposed class has at least 100 members, the amount in controversy exceeds $5 million, and minimal diversity exists among parties.
