CHICAGO (Legal Newsline) – An Illinois man is suing a clinical improvement programs organization over claims it sent unsolicited fax advertisements.
William M. Pollack, individually and for all others similarly situated, filed a class-action lawsuit March 24 in U.S. District Court for the Northern District of Illinois, Eastern Division against Best Practices Academy and John Does 1-10, alleging violations of the Telephone Consumer Protection Act, violations of the Illinois Consumer Fraud Act, conversion, private nuisance and trespass to chattels.
On Dec. 21, 2015, the suit states, Pollack allegedly received an unsolicited fax advertisement sent by Best Practices. The faxes Best Practices sent allegedly did not contain a compliant opt-out notice, and the faxes were allegedly sent without prior consent from the recipients.
Pollack and others in the class seek actual and statutory damages, injunctive relief, attorney fees and costs of the suit. They are represented by attorneys Daniel A. Edelman, Cathleen M. Combs, James O. Latturner and Heather Kolbus of Edelman Combs Latturner & Goodwin in Chicago.
