California residents allege Starbucks underfills lattes

SAN FRANCISCO (Legal Newsline) – Two California residents are suing Starbucks over claims it underfills its lattes.

Siera Strumlauf and Benjamin Robles, individually and for all others similarly situated, filed a class-action lawsuit March 16 in U.S. District Court for the Northern District of California against Starbucks Corp., alleging breach of express and implied warranties, unjust enrichment, negligent misrepresentation, fraud and violations of California's Consumer Legal Remedies Act, its Unfair Competition Law, and its False Advertising Law.

The suit states that Starbucks lattes are uniformly approximately 25 percent underfilled based on the company's standardized recipe. As a result, Starbucks allegedly has shortchanged its customers and was unjustly enriched.

The plaintiffs and others in the class seek compensatory and punitive damages, interest, restitution, injunctive relief, attorney fees and costs of the suit. They are represented by attorneys L. Timothy Fisher, Julia A. Luster, and Scott A. Bursor of Bursor & Fisher in Walnut Creek, California and New York; and by attorneys Gerald Healy and John Hafemann of Military Justice Attorneys in Beaufort, South Carolina and Savannah, Georgia.
