LOS ANGELES (Legal Newsline) – A California citizen is suing a fashion retailer and its parent company over claims they mislead consumers regarding certain watches they sell.
Vahdat Aghdasy, individually and for all others similarly situated, filed a class-action lawsuit March 17 U.S. District Court for the Central District of California against HauteLook Inc. and Nordstrom Inc., alleging common law fraud, conspiracy to commit fraud, breach of implied and express warranties, unjust enrichment, violations of California's Consumer Legal Remedies Act, and other violations of California's Business and Professions Code.
The suit states the defendants made false and misleading statements to consumers by offering Rolex-brand watches for sale to the general public, when the watches were allegedly damaged, in poor condition, and/or contained non-Rolex, inferior parts.
The defendants represent that the watches are shipped from Rolex, but they are allegedly shipped from various jewelry stores.
The defendants also allegedly misrepresent the value of the watches and mislead consumers into believing the watches are being sold at a significant discount from their true value. The suit states the defendants even provide photographs of the watches to consumers, but the photographs do not represent the actual watch that is being sold.
Aghdasy and others in the class seek declaratory and injunctive relief, restitution and disgorgement, actual damages, exemplary and/or punitive damages, interests, attorney fees, and other costs of the suit.
