California man alleges Van Heusen engaged in price scheming

LOS ANGELES (Legal Newsline) - A California man is suing a clothing retailer, alleging it offered phantom price discounts.

Scott Young, individually and for all others similarly situated, filed a class action lawsuit March 4 in U.S. District Court for the Central District of California against PVH Corp. and PVH Retail Stores, alleging violation of the California Consumer Legal Remedies Act, violation of the California False Advertising Law, and unfair, fraudulent and unlawful business practices.

The suit alleges the defendants, which operate Van Heusen, misrepresented the nature, existence, and amount of price discounts on products sold at Van Heusen Outlet Stores by alleging to offer discounts off a false "reference price."

  

These reference prices, the lawsuit states, were overstated and did not represent the actual price at which the products were previously sold.

Young and others in the class seek restitution and disgorgement, injunctive relief, actual and punitive damages, interests, attorney fees and costs of the suit.
