Florida man alleges ADT systems not as safe as marketed

MIAMI (Legal Newsline) – A Florida man is suing a home security company over claims its security systems are not as safe as the company represents them to be.

Santiago L. Hernandez, individually and for all others similarly situated, filed a class-action lawsuit March 7 in U.S. District Court for the Southern District of Florida against The ADT Corp. and ADT LLC, doing business as ADT Security Services, alleging violation of the Florida Deceptive and Unfair Trade Practices Act, negligent misrepresentation and unjust enrichment.

ADT allegedly markets its home security equipment and monitory services as being safe and reliable, boasting the company uses the most innovative and advanced technology on the market.

The suit states, however, that ADT's wireless signals are both unencrypted and unauthenticated, and unauthorized third parties can easily intercept and interfere with them. As a result, Hernandez and other ADT consumers in the class are more vulnerable and less safe than ADT leads them to believe, according to the suit.

Hernandez and others in the class seek damages, restitution and disgorgement, interests, declaratory and injunctive relief, punitive damages, attorney fees and other costs. They are represented by attorneys Jonathan M. Stein, Jorge A. Amador, Adam D. Warden and Manuel A. Miranda of Saxena White in Boca Raton, Florida.
