SAN ANTONIO (Legal Newsline) - A Texas man is suing an insurance sales leads procurer over claims it made unsolicited calls to his cellphone.

William M. Clanton, individually and for all others similarly situated, filed a class-action lawsuit Feb. 26 in the San Antonio Division of the Western District of Texas against Dollar A Day Benefits, alleging violations of the Telephone Consumer Protection Act.

The suit alleges the defendant uses an automatic telephone dialing system and/or an automatic or prerecorded message to solicit business. Clanton and other class members allegedly did not consent to receive these telemarketing calls from the defendant.

Clanton and others in the class seek injunctive relief, damages, and attorney fees and costs. They are represented by attorney Bonner Walsh of Walsh PLLC in Sonora, Texas; and by attorney Adam R. Gonnelli of Faruqi & Faruqi in New York.
