Customer alleges Windsor, Woodgrain made defective windows

MILWAUKEE (Legal Newsline) - A Wisconsin man is suing window manufacturers, alleging their windows are defective.

Shawn S. Gengler of Muskego, individually and for all others similarly situated, filed a class action lawsuit in U.S. District Court for the Eastern District of Wisconsin Milwaukee Division against Woodgrain Millwork Inc. and Windsor Window Company, doing business as Windsor Windows and Doors, alleging product liability, strict liability, breach of express and implied warranties, breach of contract, fraudulent misrepresentation and fraudulent concealment, and violations of the Wisconsin Deceptive Trade Practices Act.

The suit alleges the defendants manufacture and sell windows with a defect that allows water to pass through the window frame corners, glazing pocket, and aluminum cladding, which leads to wood deterioration on the window and water and air leakage into the home.

The lawsuit states the defendants have failed to comply with building codes and industry standards with respect to their windows, and have also denied to remedy or repair the defective windows.

Gengler and others in the class seek compensatory and punitive damages, interests, attorney fees and costs of the suit. They are represented by attorneys Kara A. Elgersma, Edward A. Wallace and Amy E. Keller of Wexler Wallace in Chicago.
