SAN DIEGO (Legal Newsline) - A San Diego woman is suing a bags and fashion accessories company, alleging it deceives consumers through pricing schemes.
Monica Rael, individually and for all others similarly situated, filed a class action lawsuit Feb. 10 in U.S. District Court for the Southern District of California against Dooney & Bourke Inc. and Does 1-50, alleging violations of California's Consumer Legal Remedies Act, the state's Unfair Competition Law and its False Advertising Law.
The suit alleges the defendants misled consumers by advertising bags and fashion accessories at phantom markdowns that were based on fictitious "market" or "regular" prices. The complaint states Dooney & Bourke conveyed this deceptive price scheme through promotional materials, in-store displays and print advertisements.
Rael and others in the class seek damages, restitution and disgorgement, declaratory and injunctive relief, and attorney fees and costs, together to exceed $5 million.
