Customer alleges Children's Place engages in price scheming

SAN DIEGO (Legal Newsline) - A San Diego woman is suing a children's apparel retailer, alleging price scheming.

Monica Rael, individually and for all others similarly situated, filed a class action lawsuit Feb. 11 in U.S. District Court for the Southern District of California against The Children's Place and Does 1-50, alleging violations of California's Consumer Legal Remedies Act, its Unfair Competition Law, and its False Advertising Law.

The suit alleges The Children's Place falsely advertises children's apparel, accessories, footwear and other items at "savings" prices, comparing the "sale" prices to "market" prices.  However, the complaint states, these "market" prices were artificially inflated, or the defendant never actually sold the products at the listed "market" price.

Rael and others in the class seek more than $5 million for damages, restitution and disgorgement, declaratory and injunctive relief, and attorney fees and costs. They are represented by attorneys Todd D. Carpenter, Edwin J. Kilpela and Gary F. Lynch of Carlson Lynch Sweet Kilpela & Carpenter in San Diego and Pittsburgh.
