SAN FRANCISCO (Legal Newsline) - A California man is suing the Hilton hotel chain, alleging a bait-and-switch scheme regarding a hotel stay rebate.
Timothy Elder, of Fremont, individually and for all others similarly situated, filed a class action lawsuit Jan. 15 in U.S. District Court for the Northern District of California against Hilton Worldwide Holdings and Hilton Grand Vacations Company, alleging breach of express and implied warranties, breach of contract, unjust enrichment, negligent misrepresentation, fraud, and violations of California's Consumer Legal Remedies Act, its Unfair Competition Law and its False Advertising Law.
The suit states Elder attended a timeshare presentation by Hilton and was given a $100 rebate certificate. However, the lawsuit states, Hilton then refused to honor the $100 rebate certificate when Elder tried to use it to stay at a Hilton hotel in Orlando in summer 2013.
Elder and others in the class seek more than $5 million in compensatory and punitive damages, interests, restitution and other equitable monetary relief, injunctive relief, attorney fees and costs of the suit.
