Suit alleges Bluebonnet B vitamins degrade over time

SAN DIEGO (Legal Newsline)—A San Diego woman is suing a dietary supplements manufacturer and distributor over claims that some of its products are not as effective as advertised.

Cheryl Northrup, individually and for all others similarly situated, filed a class-action lawsuit Jan. 12 in U.S. District Court for the Southern District of California against Bluebonnet Nutrition Corporation, alleging negligent and intentional misrepresentation and violations of California's Consumer Legal Remedies Act and other state business codes.

The suit states the defendant promotes its consumable liquid B vitamin supplements as containing various amounts of B vitamins per serving. These products allegedly become unstable after being opened and degrade over time, resulting in their failure to provide the amounts of vitamin B, including vitamin B12, as stated on the product labels.

Northrup and others in the class seek injunctive relief, disgorgement and restitution, interest, special and general damages, compensatory damages, exemplary and/or punitive damages, attorney fees, and costs of the suit, together to exceed $5 million.
