Health club customer alleges L.A. fitness businesses misrepresented memberships

LOS ANGELES (Legal Newsline) – A California man is suing several owners and operators of fitness and training facilities, alleging claims they pressured consumers into signing falsely advertised gym memberships.

Beau Briones, individually and for all others similarly situated, filed a class action lawsuit Jan. 12 in the U.S. District Court for the Central District of California against Fitness International, Fitness & Sports Clubs, LAF Canada Company doing business as L.A. Fitness and Pro Results, and Does 1-20, alleging violations of the Electronic Funds Transfer Act, the Financial Elder Abuse Act, and various California state business and civil codes.

The suit alleges the defendants pressured consumers into signing agreements for yearlong gym memberships by misleading them into believing they were only getting and paying for a month-long membership. According to the suit, the defendants misrepresented the content of the agreements that Briones and others were pressured to sign, then proceeded to take large sums of money from those who signed.

Briones and others in the class seek actual damages of more than $5 million for punitive and statutory damages, interests, attorney fees, and costs of the suit. They are represented by attorneys Todd M. Friedman and Adrian R. Bacon of the Law Offices of Todd M. Friedman in Beverly Hills.
