Fusion Modular Green Construction to pay $600,000 over allegedly failing to build homes

BALTIMORE (Legal Newsline) – Fusion Modular Green Construction LLC and its principals, William E. Sims III and Joshua S. Sims, will pay $600,000 over allegations of consumer protection violations, Maryland Attorney General Brian E. Frosh announced.

The company allegedly entered into contracts with four families to build new homes in Anne Arundel and Montgomery counties, but then did not start or complete construction – despite substantial deposits and payments from the buyers. The $600,000 settlement will cover restitution, damages, penalties and legal expenses.

“Buying a new home is the biggest investment many of us will make and when a home builder reneges on its promises and breaks the law, we will hold them accountable," Frosh said. "Before any money changes hands, consumers should make sure that a builder is registered and that all payments are protected in case something goes wrong."

The final court order also prohibits Fusion from building homes in Maryland unless they become properly registered under the state’s Home Builder Registration Act.

Buyers whose homes allegedly were not completed may seek actual loss recovery of up to $50,000 from the Home Builder Guaranty Fund.
