TALLAHASSEE, Fla. (Legal Newsline) - Florida Attorney General Pam Bondi announced a $4 million settlement has been reached with United Parcel Service (UPS) amidst allegations the company was overcharging certain government customers for inaccurate delivery of premium next-day packages.
The suit alleges that certain UPS employees violated false claims acts by overcharging governmental customers by reporting inaccurate delivery times for packages sent through next-day delivery that were really not delivered by their guaranteed delivery time. The suit also alleges that inapplicable or inappropriate exception codes were entered by certain UPS employees to excuse the late packages. The inaccurate codes made it so that the governmental clients were unable to receive refunds for late deliveries under their contract terms.
Under the settlement UPS has instituted training, monitoring and reporting compliance to address potential delivery failures and policy violations.
The settlement includes the states of California, Delaware, Hawaii, Illinois, Indiana, Minnesota, Montana, New Mexico, New York, North Carolina, Tennessee, the Commonwealths of Massachusetts and Virginia, the District of Columbia, and the cities of New York and Chicago.
The largest payouts under the settlement will go to New York for approximately $1.4 million and to Illinois with a payout of $779.415.
