LOS ANGELES (Legal Newsline) – An Orange County woman is suing a tax service company over allegations of false claims of service.

Melissa Meyer, on behalf of herself and those similarly situated, filed a class action lawsuit on Sept. 27 in the U.S. District Court for the Central District of California against ZipTax LLC, citing violations of the Unfair Competition Law and the Consumer Legal Remedies act.

Meyers alleges that the defendant misrepresented and falsely advertised to plaintiff and others affected that it would provide tax aid services.

Meyers claims that on or around March 2013, she retained the defendant to perform negotiations and enter settlements on her behalf with the Internal Revenue Service.

She alleges to have paid more than $850. Part of the service, Meyers claimed, was a promise to process a penalty abatement.

On May 22, 2014, Meyers claims that the abatement had still not been processed and that she contacted the IRS and found out that the defendant did not process the penalty abatement as promised. The complaint states that the IRS informed her she did not qualify for the abatement and that the defendant has refused to refund her money.

She is seeking a jury by trial and is suing for restitution, punitive and statutory damages, an injunction for correct behavior by the defendant, attorney and court costs, and any other rewards deemed just by the court.
