Mass. roofing company sued by law firm over unsolicited fax claims

CHICAGO (Legal Newsline) - A Cook County law firm is suing an Essex County, Mass. roofing company over alleged unsolicited faxing.

Evan Law Group LLC filed a class action lawsuit on Aug. 28 in the U.S. District Court for the Illinois Northern District against Patriot Roofing, Jeff Ristick, and John Does, citing a violation of the Telephone Consumer Protection Act (TCPA).

According to the complaint, on or about Aug. 29, 2011, the plaintiff received an unsolicited fax advertisement from the defendants advertising the goods, products and services for roofing installations, replacement, and leak repair services. The plaintiff argues that Ristick actively participated in the scheme to send the faxes without first obtaining express permission. The law group also claims that it did not invite or give permission to receive faxes and that there was no reasonable means for it to opt out of receiving faxes from the defendants, thereby violating the TCPA.

The plaintiff is suing for appropriate damages, punitive damages, attorney’s fees, costs of suit, and any further relief deem just by court. It is being represented by Phillip A. Bock and James M. Smith of Bock and Hatch LLC in Chicago.
