Florida couple sues auto club, alleging overcharging for discounted hotel bookings

A Florida couple is suing an auto club, alleging it overcharged them for discounted hotel bookings.

Iris and Stanley Rothstein of Palm Beach, on behalf of themselves and others, filed a lawsuit Sept. 2 in U.S. District Court for the Southern District of Florida against Auto Club South and American Automobile Association, alleging breach of contract and unjust enrichment.

According to the complaint, the defendants have made it a practice of overcharging the Rothsteins and others through undisclosed and unauthorized fees for booking hotel accommodations through the American Automobile Association (AAA) website. As such, the suit says, the plaintiffs and all other using the website have actually been charged more than they would have if they had booked the reservations with the hotels in questions directly. 

The plaintiffs charge the defendants with unjust enrichment, which, together with other similar plaintiffs, exceeds $5 million, exclusive of interest and cost.

The Rothsteins seek full monetary damages, attorney fees and expenses, court costs, interest, and any other further legal relief deemed just by the court, plus a jury trial. They are represented by attorneys Jayne Arnold Goldstein of Pomerantz, of Weston, and Noah Axler of Donovan Axler, of Berwyn, Pa.
